States with racially segregated educational systems cannot satisfy the "separate but equal" provision of Plessy merely by offering to pay for black students to be educated at an out-of-state institution; they must offer those opportunities in-state. Decided December 12, 1938 (argued November 9, 1938). Opinion of the Court: Charles Evans Hughes → go there Dissenting: McReynolds. Applied: the Fourteenth Amendment → go there Topic: Discrimination based on race and ethnicity. Missouri ex rel. Gaines v. Canada, 305 U.S. 337 (1938), was a United States Supreme Court decision holding that states which provided a school to White students had to provide in-state education to Black students as well. States could satisfy this requirement by allowing Black and White students to attend the same school or creating a second school for Black students. Wiki link
